This Agreement sets out the legally binding terms for your use of the Application and membership. The Terms of Use mentioned in this Agreement (hereinafter referred to as the said “Terms'' collectively as well as severally) govern your use and/or purchase and/or avail of the Mobile Applications, content, products, and services offered through Kokan Vadhuvar, other associated URLs and products, and services (hereinafter referred to as the said “Mobile Application” or “App” or "Mobile Apps"). The said Mobile Application is owned, managed, and controlled by M/s Susha Branding Solutions Pvt Ltd (hereinafter referred to as the Owner). This Agreement may be modified by KOKAN VADHUVAR from time to time. The membership and rights of admissions are reserved. This Terms of Use is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
Kokan vadhuvar is an advertising platform that provides targeted advertising services for matchmaking alliances and the said services can be availed either through this Mobile Application and/or through any other offline mode (as specified hereunder). This application is intended for the personal use of individual members to promote and promote their profiles to find relevant matches, and may not be used in connection with any commercial endeavor. The application is a serious platform looking for a life partner for marriage and is not a casual dating Application. The instant Terms shall deem to include and shall always apply (to the extent applicable) to the online and/or offline services.
For a better and more detailed understanding of this Agreement, the definitions of the terms mentioned hereunder shall read and be understood as mentioned below but shall not be limited to the same and would acquire the meanings as per the law as and when the time arises.
Further, the below-mentioned definitions are crucial for understanding the Marriage system and therefore not in any case intended to derogate or comment upon any Member’s/Citizen/Individual’s status.
"Annulment and/or Annulled marriage" would mean and include such marriages which have been declared null and void by the Court of Law. However, an Appeal pending against such an Order of Nullity shall not be deemed to be a final Order of Nullity till the Appeal has reached the finality of proceedings.
“Awaiting Divorce” would mean and include a person who has filed for Divorce in a Court of Law, however, a decree of Divorce has not been granted as yet.
“Bride and/or Prospective Bride” would mean and include a woman more than 18 years of age who is never married and/or a widow and/or divorcee and/or awaiting divorce. Hereinafter referred to as “person”.
“Bride Groom and/or Prospective Bride Groom” would mean and include a man more than 21 years of age who is never married and/or a widow and/or divorcee and/or awaiting divorce. Hereinafter referred to as “person”.
“Divorcee” would mean and include a person who has already obtained a Decree of Divorce from a Court of Law. However, the pendency of an Appeal against any Decree of Divorce shall not be deemed to be a Decree unless such an Appeal has reached the finality of proceedings.
“Exclusive Membership” would mean and include some special services against payment of special fees (as may be prescribed) wherein a member opting for such service shall be assisted and/or helped by the representative of the said Mobile Application to select a prospective partner under the terms and conditions hereunder mentioned.
“Marriage Laws” would mean and include the existing laws of India about Marriage and includes personal Marriage Laws either codified and/or uncodified.
“Matrimony Services” would mean and include the services being offered through the Mobile Application titled Kokan vadhuvar and/or are hereinafter referred to as the “services”.
“Member” would mean a person who has opened a profile on the said Mobile Application.
“Unmarried” would mean a person who has not been married as per the Laws of India.
“Photo Identity & Address Proof” would mean a photo identity and/or photo identity along with an address issued by any Statutory Authority, including but not limited to Passport, Driving License, Election Photo Identity Card, Addhar Card, and PAN Card.
“Profile” would mean a page wherein the details about the person are provided along with a profile picture which may and/or may not be visible to other members subject to the completion of the Registration Process and/or Verification.
“Registration” would mean and include the creation of a profile by a person and such registration process would be complete only upon verification of the profile.
“Relationship Manager” would mean and include any person who would assist the registered user in addressing technical issues about the app.
“Verification” would mean and include matching the name and photograph provided in the profile with the photo identity, address, Job & Business provided by the profile creator.
“Widow & Widower” would mean a person whose spouse is no longer living.
The definitions provided hereinabove are merely indicative of a better understanding of our services and these definitions shall always deem to include and cover any meaning from a broader perspective. Apart from the abovementioned definitions, some words or phrases might be directly defined in the clauses where used and those too shall be indicated to be part of the definitions as mentioned in the instant clause.
To use the Kokan vadhuvar Services, you must register as a member
on the Mobile Application (“Application”). This Agreement is an electronic contract that establishes the legally binding terms you must accept to use the Application and to become a "Member." By using the Application, you agree to be bound by these Terms of Use ("Agreement"). If you wish to become a Member and promote/ advertise your profile to other Members and make use of the Kokan vadhuvar service ("Service"), read these Terms of Use and follow the instructions in the registration process. By using the Service, you consent to submit your personally identifiable information including sensitive personal data such as your financial data if opted for our paid membership, Identity proofs if submitted, religion, etc, to collect, process, display, and use the said information to provide the Service and if you have any objection in collecting/processing your personal data, we advise you not to register with our Application.
If you want to withdraw this consent or if you have any objection to the continuous collection or storage of your personal details, you must discontinue using our Service and delete your account by sending an email from your registered email ID to sushabranding@gmail.com.
To register as a member of Kokan vadhuvar or use this application, you must be of legal capacity and the legal age of marriage under Indian law (currently 21 years or older for females and 21 years of age or older for men).
Application is intended solely to facilitate personal publicity for a legal marriage union between persons who have the legal authority to marry according to the laws to which they are subject. Membership of the Service is void if prohibited. Same-sex couples and/or marriages are not yet part of our Service.
By using this Application, you represent and warrant that you have the right, consent, authority, and legal capacity to enter into this Agreement; send us relevant information; and you are not prohibited or prevented by any applicable law in force or by any order or decree or order of a court, arbitrator or any other competent authority preventing you from proceeding to marriage.
You further confirm that you intend to seek a life partner and that you will not use this Application for casual encounters. You also agree to abide by all terms and conditions of this Agreement. If at any time Kokan vadhuvar believes (in its sole discretion) or has reason to believe that you are ineligible to become a Member or that you have made a false statement, Kokan vadhuvar reserves the right to judge you and immediately terminate your membership and/or your right to use the Services without refund of any of your unused subscription fees.
By using this Application, you agree that match emails or match search results presented by the system are based on the affiliate preference details you provide in your profile.
You are responsible for maintaining the confidentiality of the credentials you provide during the registration process, and you are solely responsible for all activities that occur under your account. In the event of any security breach, you agree to notify us immediately and log out of your account at the end of each session.
To access the Mobile Application you require an internet and/or data connection and standard charges of your service provider shall apply.
This is not a dating Mobile Application and you may refrain from using this Mobile Application and any of its services in the event we feel that you would wish to use the Mobile Application for dating purposes.
To activate and open your profile you have to provide a profile picture. Profiles without profile pictures shall not go live irrespective of the payment being made and/or other particulars being provided.
A scanned copy of a valid photo, identity proof, and address proof should be uploaded at the time of Registration.
This Agreement is valid, effective, and will survive as long as you use our application. The length of your paid membership depends on the type of membership you received. In the event of business interruption, charges paid for availing of our services cannot be refunded.
This Application is intended for personal use by individual members to promote and foster their profile and obtains consent for related matches and may not be used in connection with any commercial purposes. This includes providing links to other Applications, whether or not they conflict with Kokan vadhuvar. Organizations, businesses, and/or businesses may not use Kokan vadhuvar 's services or this application for any purpose. Illegal and/or unauthorized use of the Application, including unauthorized framing or linking to the Application, will be investigated and appropriate legal action taken. This includes, but is not limited to, civil, criminal, and injunctive relief.
Kokan vadhuvar reserves the right, at its sole discretion, to review the activity and status of any account and, based on such review, to block access by members
Kokan vadhuvar reserves the right, at its sole discretion, to restrict or deny you free access to its Application based on your activity, status, or any other criteria Kokan vadhuvar deems fit and proper.
You hereby confirm that as of the date of this registration, while you are a member, you do not object to receiving emails, SMS/WhatsApp messages, and calls from Kokan vadhuvar and Kokan vadhuvar members including an SMS authorization to authenticate mobile transactions with an OTP sent by the payment gateway. This consent overrides any preferences you have set or registered in Do Not Disturb (“DND” registration)/National Customer Preference Registry (NCPR). This consent applies to emails, messages, or calls, as well as phone number
verification, the provision of matchmaking advertising services, matchmaking requests, and advertising.
Multiple profiles of one person are not allowed on our Application. Kokan vadhuvar reserves the right to disable all multiple profiles without a refund of the subscription fee.
You confirm that the Content, including the personal information you provide, is correct and accurate. If you create a profile on behalf of your friend/sibling/children, you hereby agree that you have the necessary permission of the specific person of the profile created by you on Kokan vadhuvar. Imitation is a crime and is punishable by various laws.
Kokan vadhuvar strictly advises you to send a copy of your driver's license, passport, or any other government and add a confidential mark to your profile.
Other than advertising/promoting your dating profile, you may not engage in advertising or soliciting other members to buy or sell products or services through the Application.
You should not send chains or unwanted emails to other Kokan vadhuvar members. Although Kokan vadhuvar cannot monitor the behavior of its members with Application, it is also a violation of these rules to use any information obtained from other members in order to harass, abuse, or harm another person, or in order to contact, advertise to, solicit, or sell to any Member without their prior explicit consent.
You shall always refer to the Mobile Application for the ongoing scheme and/or the services associated with the schemes.
In the event your number is registered with the National Do Not Disturb Register then you shall not be able to avail of our service. Change in the information provided in the Mandatory Fields shall only be effective upon resubmission of supporting and necessary documents. Charges for availing of our services once paid cannot be refunded under any circumstances whatsoever.
You will not send or otherwise post unauthorized commercial communications (such as spam) on the said Mobile Application and/or during the usage of any of our services.
You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on Kokan vadhuvar.
You will not upload viruses or other malicious code.
You will not solicit login information or access an account belonging to someone else.
You will not bully, intimidate, or harass any user.
You will not use Kokan vadhuvar, to do anything unlawful, misleading, malicious, or discriminatory.
Kokan vadhuvar reserves the right to take necessary measures to protect Kokan vadhuvar and/or its members from any abuse/misuse.
You hereby agree that you will not use the Services of Application to harass any Member, including the Meet/Near Me feature.
You may not use any automated process, including IRC bots, EXE, CGI, or other programs/scripts, to view content or interact/communicate/respond/communicate with Kokan vadhuvar and/or its members.
Kokan vadhuvar has the right to publish and govern communications/advertisements that you can send to another member (s) and to delete unnecessary communication/advertising/porn at any time and without any notice to any of its members.
You hereby give your consent to us that your profile (includes a profile of third parties) shall be created by Kokan vadhuvar based on your inputs and you further give Kokan vadhuvar the right to maintain and/or access the said profile during your package period.
You acknowledge that Kokan vadhuvar cannot ensure the quality of the matching profiles. Nearest matching profiles as available in the Database of Kokan vadhuvar may be sent to you by App notification.
You can change your choice of the prospective match from your end through the Mobile Application, and the profiles being sent to you shall change by the change made by you.
Kokan vadhuvar Members who subscribe to Kokan vadhuvar hereby join the service and unconditionally and unconditionally agree to read and abide by the terms.
Not to share your personal information including but not limited to your Credit and/or Debit Card number and/or Bank Account Details, etc with any person whatsoever including the authorized representative of Susha Branding Solutions Pvt Ltd. till the extent required to be disclosed by you. We shall not be liable for any unauthorized disclosure which may result in loss and damage to you.
You shall only contact us at the number provided to you. We shall not be responsible for any commitments made to you and/or payments made by you to any person outside the scope of these terms and conditions.
Members should maintain copies of acknowledgments and/or receipts provided to you against your payments.
We shall retain and/or store and/or exploit either commercially and/or non-commercially your pictures and/or information provided by you through any medium whatsoever and you hereby grant us an exclusive and royalty-free right and/or title and/or interest to use and exploit the same. In this regard, you are further requested to read our privacy policy for better and further particulars.
You may submit your Aadhaar Card to Kokan vadhuvar as a valid photo ID. You understand that on submission Kokan vadhuvar will be retaining & using the information on the Aadhaar card & match the details given in your profile.
You have been informed that sensitive personal information is accessible through the Aadhar Card and acknowledge that Susha Branding Solutions Pvt Ltd. will not be responsible for any access or disclosure of your sensitive personal information by any unauthorized person or through unauthorized means.
Kokan vadhuvar claims and holds all restrictive rights with the Kokan vadhuvar Application and the Kokan vadhuvar Services. The Application contains the copyrighted material, trademarks, and other exclusive data of Kokan vadhuvar, and its licensors. Except for that information that is within the open space such as a member profile or for which authorization has been gotten from the client, you cannot duplicate, alter, distribute, transmit, disseminate, perform, show, or offer any such exclusive data. Any such act or an endeavored act on your portion might constitute an infringement of this Agreement and your participation is obligated to be ended forthwith by Kokan vadhuvar without discount of any of your unused Membership expenses. Kokan vadhuvar saves the right to require legitimate activity (gracious and/or criminal) wherever pertinent for any infringement
You understand and agree that Kokan vadhuvar may, in its sole discretion, remove any listing, content, message, photo, or profile (collectively, "Content") that violates this Agreement or is offensive, illegal, or otherwise. Doing so may violate, harm, or threaten the security of Kokan vadhuvar and/or its member.
With respect to Content you submit or make available for inclusion in publicly accessible areas of the Application including but not limited to
your contact details, you hereby unconditionally and irrevocably grant to Kokan vadhuvar the consent and license to use, store, distribute, reproduce, prepare derivative works of, modify, adapt, publicly perform and publicly display such Content on the Application and to the members of Kokan vadhuvar Application(s) from time to time.
By presenting your success story, you confirm this on Kokan vadhuvar to use, publish and display your photos and readings on the app.
You understand and hereby agree that all information, data, text, photographs, graphics, communications, tags, or other Content whether publicly posted or privately transmitted or otherwise made available to Kokan vadhuvar the sole responsibility of the person from whom such Content originated, and shall be at the member's/person's sole risks and consequences. This means that you (and not Kokan vadhuvar) are solely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. Kokan vadhuvar does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. We advise all User/s to independently verify the content /information posted by the other members before acting upon the same and under no circumstances will Kokan vadhuvar be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.
Kokan vadhuvar reserves the right to verify the accuracy of the content published on the Application. In exercising this right, Kokan vadhuvar may require you to provide any documents or other evidence to support the content you post on the Application. If you do not provide such proof to Kokan vadhuvar's satisfaction, it may, in its sole discretion, terminate your membership without a refund.
Below is an inclusive list of all types of illegal or prohibited content on the Application which includes everything that is prohibited but shall not be limited to the below-mentioned types. Kokan vadhuvar shall, at its sole discretion, take appropriate legal action against anyone who violates this Agreement, including but not limited to removal of the offending message/content from the Service and permanent termination of membership of such violators. Illegal and prohibited content includes content that:
Is openly offensive to society, such as content that promotes racism, bigotry, hatred, or any physical harm to any group or individual;
Persecution or support of persecution of another person.
It includes sending "junk letters", "chain letters" unsolicited bulk emails or "spam".
Promotes information that you know to be false, misleading, or offensive activities or conduct that is offensive, threatening, obscene, libelous , or defamatory.
An illegal or unauthorized copy of other people's printing works, namely providing pirate computer programs or providing information to them, providing information to prevent the preparation of equipment for copying or music for robbery or references for looting music or looted music.
Access only pages or password only pages or hidden images (not connected to the other side of access).
Displays any obscene or sexually explicit content.
Provides content that sexually or sexually exploits persons under the age of 18 or solicits personal information from persons under the age of 18.
Provides educational information about illegal activities, such as manufacturing or purchasing illegal weapons, invading people's privacy, or distributing or creating computer viruses.
Solicits passwords or personal information from other users for commercial or illegal purposes; AND
Engage in commercial and/or sales activities without prior written consent, such as contests, sweepstakes, barter-exchange, promotions, and pyramid schemes;
You shall be contacted from time to time and/or you may contact our sales representatives at the number provided in the Application. During such conversations, any promise made by the Owner’s representatives to you which is beyond the scope of services in your scheme and/or not mentioned in the Application terms and conditions, shall not be considered a valid commitment as far as the Owner is concerned. The owner holds no liability towards losses/damages that occurred due to said false commitment.
Kokan vadhuvar has the right to publish and govern communications/advertisements that you can send to another member (s) and to delete unnecessary communication/advertising/porn at any time and without any notice to any of its members.
Kokan vadhuvar Members who subscribe to Kokan vadhuvar hereby join the service and unconditionally and unconditionally agree to read and abide by the terms.
10.9 . You must use the Kokan vadhuvar Service in a manner consistent with any and all applicable local, state, and federal laws, rules, and regulations.
10.10 You cannot include in your Member profile, visible to other members, any telephone numbers, street addresses, URL's, and email addresses.
You may cancel your membership at any time for any reason by contacting Kokan vadhuvar in writing. If you terminate your membership, you are not entitled to a refund of any unused subscription fees paid, if any, unless otherwise guaranteed in writing.
Kokan vadhuvar reserves the right to refuse access to and/or access to the Application for any reason, including but not limited to, violation of the Terms of Use, use of the Service for commercial purposes, prohibited or engaging in inappropriate communications or activities. If Kokan vadhuvar terminates your membership for breach of the terms of this Agreement, you will not be entitled to a refund of any subscription fees paid.
A member may willingly terminate his membership by sending an email to Kokan vadhuvar on any event of disliking, fulfillment of its motive of using the application, or any reason whatsoever, and such profile shall be discontinued immediately. However, the Member shall not be entitled to any refund for his willful termination.
You may not publish, distribute or in any way reproduce the copyrighted material, trademarks, or other confidential information without the prior written consent of the owner of such proprietary rights. Without limiting the foregoing, if you believe that your work has been copied and published on the Kokan vadhuvar Service in a manner that constitutes copyright infringement, please provide us with the following information;
electronic or physical signature of a person authorized to act on behalf of the owner of the copyright;
A description of the copyrighted work that you claim has been infringed;
Explanation of the Application you claim was broken.
Your address, phone number, and email address;
The written statement you have written that you have confidence that a contradictory request is a right to print, his representative or law is not recognized as a law.
The report you have indicated that the above information is accurate in your statement and you may act on behalf of the right to print or the right to print. Notification of claimed copyright infringement may be sent to us in writing at the Mumbai address provided in the Help/Contact section of the Application.
Use of the Application and/or the Service is governed by our Privacy Policy and follows guidelines to protect your privacy.
Kokan vadhuvar is not responsible for any incorrect or inaccurate Content/listing posted on the Application or in connection with the Kokan vadhuvar Service, whether caused by Users, Members, or by any of the equipment or programming associated with or utilized in the Service nor for the conduct of any User and/or Member of the Kokan vadhuvar Service whether online or offline.
Kokan vadhuvar assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, User and/or Member communications or any communications by Kokan vadhuvar to its Members.
Kokan vadhuvar is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Application or a combination thereof, including injury or damage to Users and/or Members or any other person's computer related to or resulting and/or in connection with the Kokan vadhuvar Service.
Under no circumstances will Kokan vadhuvar be responsible for any loss or damage resulting from anyone's use of the Application or the Service and/or any Content posted on the Kokan vadhuvar Application or transmitted to Kokan vadhuvar Members. You should not provide your financial information (for example, your credit card or bank account information), or wire or otherwise send money, to other Members.
The exchange of matchmaking profile(s) through or by "Kokan vadhuvar" is not a matrimonial offer and/or recommendation from/by Kokan vadhuvar. Kokan vadhuvar shall not be responsible for any loss or damage to any individual arising out of, or after, any relations (including but not limited to matrimonial relations) established under the use of Kokan vadhuvar service.
The Application and the Service are provided "AS-IS" and Kokan vadhuvar expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Kokan vadhuvar cannot guarantee and does not promise any specific results from the use of the Application and/or the Kokan vadhuvar Service. You understand that Kokan vadhuvar makes no guarantees, either express or implied, regarding compatibility with individuals you meet through the Service.
Kokan vadhuvar expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any Content/listing posted on the Application / made available to Kokan vadhuvar by any Members or the users of the Application or any third party.
Kokan vadhuvar does not assume any responsibility or liability for any illegal Content posted on the Application by any Members, users, or any third party.
All liability, whether civil or criminal arising out of any Content that is posted on the Application will be of that Member/user / third party who had posted such Content, and Kokan vadhuvar reserves its right to claim damages from such Member/ user / third party that it may suffer as a result of such Content Posted on the Application. Kokan vadhuvar does not claim ownership of the Content you submit or make available for inclusion in the Service.
Application’s role is limited to matching the picture provided in the “Profile Photo” section with the photo appearing in the Identity and/or Address Proof.
Kokan vadhuvar shall not be liable and/or responsible if your profile and /or picture is used by a third party claiming to be your friend and/or relative and/or parent and/or guardian. It will be deemed that your implied consent was always available to the person who has opened the profile on your behalf.
Parent’s Phone numbers will be used while displaying the profile. If the member/user enters a phone number different from the parent's phone number then the member/user will be responsible for the phone number displayed on the profile
Our role under the services of “Membership” would be strictly limited to shortlisting suitable profiles only as per your choice. You are advised to use your discretion while contacting and/or meeting the profiles shortlisted by us based on your choice.
If you opt for the service of “Membership” you hereby give your consent to receive the information about prospective matches via your registered mobile number via SMS.
If otherwise not indicated Kokan vadhuvar shall send the matches in a frequency as determined by us as per your package.
One SMS with a contact number is equivalent to one contact feature as per your opted plan.
If you wish to opt-out from receiving SMS kindly send a mail with your specific request to sushabranding@gmail.com Any other form of communication shall not be taken into consideration.
We only give you an indication of the number of prospective matches that you may get, however, the actual numbers are subject to the actual availability of profiles.
No refund shall be made under any circumstances.
We do not vouch for the genuineness of the documents provided by the users. Kokan vadhuvar shall not in any manner whatsoever intervene in any personal and/or family dispute arising between the prospective partners and/or their family members.
All prospective members are requested to use their discretion and/or wisdom while making contact with your prospective partner.
We shall not be responsible under any circumstances whatsoever in the event of any legal dispute both civil and/or criminal and/or matrimonial before and/or after marriage.
We do not vouch for the physical and mental health and/or fitness of the prospective members.
In the event you are planning a marriage with a divorcee, you are requested as an abundant caution to inspect and/or make necessary inquiries as to whether any appeal is pending against the Decree of Divorce.
Decree of Divorce does not mean finality of proceedings, it is just an indication of the marital status of the person on the date on which the Decree was passed.
We do not vouch for the employment-related details provided by the members.
Your usage of this Mobile Application and/or services is purely voluntary and hence you hereby indemnify.
User shall be held responsible for any loss and/or damage caused by inappropriate usage of our Mobile Application and/or defamatory statements against the interests of Susha Branding Solutions Pvt Ltd on any social media platforms and/or in the public domain, Susha Branding Solutions Pvt Ltd shall reserve the right to take legal action to recover loss and/or damage caused. By using the said Mobile Application and/or services, if the user suffers any loss and/or damage which is not attributable to Susha Branding Solutions Pvt Ltd in our reasonable opinion, then, in such a situation we shall not be responsible under any capacity whatsoever.
You shall only deal with the authorized representative of the Owner.
We shall not be liable for any payment that you make to any other person other than the authorized representative of Kokan vadhuvar. in the form and manner as may be told to you.
The Mobile Application is not free from errors and our services can be affected by errors and/or mistakes.
We reserve the right to de-list any profile and/or block and/or deactivate any profile without any prior intimation whatsoever.
We reserve the right to cancel and/or suspend and/or close down the said Mobile Application at any point in time without any prior intimation whatsoever;
In the event of a Dispute the Courts shall have exclusive jurisdiction and you hereby agree to the Jurisdiction of Courts as mentioned herein.
By using our Mobile Application and/or its services you hereby expressly and/or impliedly absolutely and/or forever agree to bind yourself to these terms and conditions without any protest and/or demur.
We shall be at liberty to post your profile details along with your photograph on the public display portion of our Mobile Application for the promotion of your profile at our sole discretion. You hereby give your consent for such posting of our profile on the public display portion of our Mobile Application.
The aforesaid terms and conditions can be altered and/or amended at any point in time without any prior intimation whatsoever.
Rules Relating to Membership:
Upon enrollment into the Membership services, any of our authorized representatives will assist you with the process of understanding the Mobile Application when approached by the User.
Members will endeavor to provide a profile(s) as per their set partner preference subject to the availability of the profile in our database. You acknowledge that we shall only search for your preferred partner in our existing database in our Mobile Application named Kokan vadhuvar and we shall not under any circumstances solicit any other means and/or source for your preferred partner.
The member’s service will be carried out only during normal working hours of members i.e., 10:30 am to 07:00 pm Monday to Friday excluding Saturday & Sunday and public holidays for Indian Members.
In no event will Kokan vadhuvar be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages, including also lost profits arising from your use of the Application or the Service, even if Kokan vadhuvar has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Kokan vadhuvar's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Kokan vadhuvar, for the Service during the term of membership.
If there is any dispute about or involving the Application and/or the Service, by using the Application, you unconditionally agree that all such disputes and/or differences will be governed by the laws of India and shall be subject to the exclusive jurisdiction of the Competent Courts in Mumbai, India only.
You agree to indemnify and hold Kokan vadhuvar, its subsidiaries, affiliates, officers, agents, and other partners and employees, fully indemnified and harmless from any loss, liability, claim, or demand, including reasonable attorney's fees, made by any third party due to or arising out of your use of the Service in violation of this Agreement and/or arising from a breach of these Terms of Use and/or any breach of your representations and warranties set forth above and/or any fraudulent activity on your part.
Susha Branding Solutions Pvt Ltd reserves the right to suspend/cancel, or discontinue any or all channels, products, or services at any time without notice, make modifications and alterations in any or all of the content, products, and services contained on the Mobile Application without prior notice. Such changes will be posted to the said Mobile Application for your reference and convenience to enable you to understand your responsibility as a user.
Susha Branding Solutions Pvt Ltd reserves the right to charge subscription and/or membership fees from a user in respect of any product, service, or any other aspect of this Mobile Application. Such charge of fees may be without any prior intimation at the sole discretion of Susha Branding Solutions Pvt Ltd.
Disclaimer of Warranties and Liability:
Susha Branding Solutions Pvt Ltd and its directors, stakeholders, employees, affiliates and associates shall not be liable, at any time for any, direct, indirect, punitive, incidental, special, consequential, damages (including, without limitation, damages for loss of business projects, damage to your computer system or damages for loss of profits, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Susha Branding Solutions Pvt Ltd’s Mobile Applications/services, with the delay or inability to use the Susha Branding Solutions Pvt Ltd’s Mobile Applications/services or related services, the provision of or failure to provide services, or for any information, software, products, services and related
graphics obtained through the Susha Branding Solutions Pvt Ltd’s Mobile Applications/services, or otherwise arising out of the use of the Susha Branding Solutions Pvt Ltd’s Mobile Applications/services) arising in contract, tort or otherwise from the use of or inability to use the Mobile Application, or any of its contents, or from any act or omissions a result of using the Mobile Application or any such contents or for any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of information contained on the Mobile Application. No representations, warranties, or guarantees whatsoever are made by Susha Branding Solutions Pvt Ltd as to the;
accuracy, adequacy, reliability, completeness, suitability, or applicability of the information to a particular situation;
that the service will be uninterrupted, timely, secure, or error-free;
the quality of any products, services, content, information or other material purchased or obtained from the Mobile Application will meet your expectations or requirements; or
Any errors in the Mobile Application will be corrected.
Contest (as and when it is applicable):
The online contest (hereinafter referred to as the said contest) is being conducted and organized by Susha Branding Solutions Pvt Ltd.
To participate in this contest the participants need to have an active profile in the said Mobile Application.
The details of the contest shall be provided from time to time and the participants are requested to follow the same.
The contest period shall be solely determined by Susha Branding Solutions Pvt Ltd and the start date & time, and end date & time shall be duly communicated to you from time to time.
Susha Branding Solutions Pvt Ltd shall have the sole discretion in deciding the mode and method of selection of the winners.
The date and time of revealing the result of the contest shall be at the sole discretion of Susha Branding Solutions Pvt Ltd.
This participation on in this contest is purely voluntary and a participant may have to provide his / her details. If a participant does not wish to provide the details as asked for then he/she may back out from participating in the contest.
No acknowledgment SMS and/or email shall be sent to the participant of the contest.
Standard Data charges shall apply, participants, are requested to inquire about the same with their Operators.
The winners may be given certain gifts and the nature of the gift would be decided by Susha Branding Solutions Pvt Ltd.
The Gifts are non – transferable and cannot be redeemed against cash.
Susha Branding Solutions Pvt Ltd is only liable to provide gifts (if any) to the lucky winner(s) and Susha Branding Solutions Pvt Ltd shall not be responsible under any circumstances for the quality and/or usage and/or manufacturing defect and/or any other problems and/or disputes arising out of the gifts.
Susha Branding Solutions Pvt Ltd shall not be liable and/or responsible in any manner whatsoever due to any problem arising out of your internet service provider.
Susha Branding Solutions Pvt Ltd reserves the right to discontinue the contest at any point of time at their sole discretion.
In the event of any dispute the decision of Susha Branding Solutions Pvt Ltd shall be final and binding.
o Any dispute arising out of the said contest shall be strictly within the Jurisdiction of the Courts of Navi Mumbai, Maharashtra, India.
Susha Branding Solutions Pvt Ltd shall not be responsible and/or liable for any loss and/or damages including physical and mental damages and/or susufferinghat may occur to any person and/or participant due to the participation in the said contest.
Susha Branding Solutions Pvt Ltd reserves the right to change the aforesaid terms and conditions at any point in time without any prior intimation.
Susha Branding Solutions Pvt Ltd reserves the right to disqualify any winner without assigning any reason whatsoever.
Your participation in the said contest is deemed to be an acceptance of the aforesaid terms and conditions.

Susha Branding Solutions Pvt Ltd may send information and offer products and services to you from time to time. For further details relating to our policy relating to such offers please refer to our privacy statement. Notwithstanding the foregoing, Susha Branding Solutions Pvt Ltd reserves the right to disclose any information in response to/that it is required to be shared, disclosed, or make made available to any governmental, administrative, regulatory, or judicial authority under any law or regulation applicable to Susha Branding Solutions Pvt Ltd
Further, Susha Branding Solutions Pvt Ltd can (and you authorize Susha Branding Solutions Pvt Ltd to) disclose your name, street address, city, state, zip code, country, phone number, email, and company name to Intellectual Property rights owners, as we in our sole discretion believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity.
Relationship:
None of the provisions of the User Agreement shall be deemed to constitute a partnership or agency between you and Susha Branding Solutions Pvt Ltd and you shall have no authority to bind Susha Branding Solutions Pvt Ltd in any manner, whatsoever.
Force Majeure:
Susha Branding Solutions Pvt Ltd shall have no liability to you for any interruption or delay, to access the Mobile Application irrespective of the cause.
Entire Agreement:
These Terms of Service constitute the entire agreement between the parties concerning the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings or agreements, written or oral, regarding the such subject matter.
Time Bound Claims:
You and Susha Branding Solutions Pvt Ltd agree that any cause of action arising out of or related to the Susha Branding Solutions Pvt Ltd’s Mobile Applications, only, must commence on or before your membership with Susha Branding Solutions Pvt Ltd gets over, otherwise, such cause of action will be permanently barred.
Acceptance of Terms & Conditions:
By using Susha Branding Solutions Pvt Ltd’s Mobile Applications and services, you confirm and signify your acceptance of these Terms & Conditions. If you do not agree or are not comfortable with any term described in this Terms & Conditions, your only remedy is to discontinue the use of Kokan vadhuvar Mobile Applications. We reserve the right to modify these Terms & Conditions at any time.
General Terms:
Rights and obligations under the Terms which by their nature should survive will remain in full effect after termination or expiration of the Terms.
Any express waiver or failure to exercise promptly any right under the Terms will not create a continuing waiver or any expectation of non-enforcement.
If any provision of the Terms is held invalid by any law or regulation of any government, or by any court or arbitrator, the parties agree that such provision will be replaced with a new provision that accomplishes the original business purpose, and the other provisions of the Terms will remain in full force and effect.
By becoming a Member of the Kokan vadhuvar service, you agree to receive certain specific emails from Kokan vadhuvar and/or its group Application. You can unsubscribe at any time for any reason quickly and easily by clicking on the unsubscribe link enclosed in the mail. You can also manage your subscription to these emails using the respective option.
This Agreement, accepted upon use of the Application and further affirmed by becoming a Member of the Kokan vadhuvar, contains the entire agreement between you and Kokan vadhuvar regarding the use of the Application and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.
By becoming a member of Kokan vadhuvar and/or using the Services of the Application, you unconditionally and irrevocably confirm that you have read and understood the above provisions and agree to abide by them. If you are not agreeing to any of the above terms and conditions please refrain from registering on the Application.

This Agreement is an electronic document in terms of the Information Technology Act, 2000, and Rules there under about electronic records as applicable and amended. This electronic record is generated by a computer system and does not require any physical or digital signatures.
